How Much Time Do You Actually Have?
Florida is a judicial foreclosure state, which means your lender has to sue you in court before your home can be sold — it can’t happen through a simple notice, the way it can in some other states. Federal law also generally requires your loan servicer to wait until you’re more than 120 days behind before starting that process. Once a lawsuit is filed, you typically have 20 days to respond, and from there, a Florida foreclosure case commonly takes anywhere from several months to well over a year to reach a sale date, depending on your county’s court backlog and whether the case is contested.
